Terms of Service

The agreement between you and IncognitoH, in plain words.

Using IncognitoH

By creating an account you agree to these terms and to the Privacy Policy. You must be at least 18 years old, and old enough to work and to enter a contract where you live. The service is not directed at children.

One account per person, in your own name or, for a recruiter, on behalf of a company you genuinely recruit for. You may not open an account for someone else or use another person's identity to open one.

You are responsible for what you put in your profile and for keeping your sign-in details to yourself. Tell us promptly if you think someone else has access to your account.

Your content

Your resume and profile remain yours. You give us permission to store and process them for the purpose of operating the service: making you findable, generating summaries, and passing on details you have chosen to release. That permission ends when you delete the content, except where we are required to retain something.

You confirm that what you upload is accurate and yours to upload, and that it does not contain another person's confidential information.

Posting in the community feed

Posts and comments are visible to everyone signed in. You keep ownership of what you write; you give us permission to display and distribute it on the platform for as long as it is published.

Everything posted is checked automatically before it goes live, and content that fails those checks is refused. We may also remove a post or a comment after publication, and repeated breaches may cost you the ability to post. If you think a refusal or a removal was wrong, write to us and a person will look at it.

Some of what you see in the feed is starter content: posts and comments we wrote and published under aliases of our own, so that a new member sees how the community works before it has many members. Nobody is charged for it, no recruiter can find the accounts behind it, and we retire it as real activity grows.

• No harassment, abuse, threats, or targeting of an individual.
• No sexual content, graphic violence, or content that exploits anyone.
• No attempt to identify another member, on the feed or anywhere else.
• No advertising, spam, or repeated posting of the same content.
• No confidential information belonging to an employer or a client.

What you may not do

• Attempt to identify a candidate who has not released their details.
• Scrape, bulk-download, or resell information from the service.
• Misrepresent who you are or who you work for.
• Use the service to harass or discriminate against anyone, or for anything unlawful.
• Interfere with the service, or attempt to access parts of it you have not been granted access to.
• Use an automated tool to create accounts, send invitations, or drive any part of the service.

Invitations and referrals

You may invite people you know. Only invite someone who would reasonably expect to hear from you, and only using an address you came by honestly; we send the invitation on your behalf and your name appears on it. Invitations are limited per day, and we may withdraw the ability to send them.

Where a referral offer is running, the terms of that offer are shown with it: how many referrals qualify, how many rewards are available, and what the reward is. A reward is personal to you, has no cash value, and cannot be transferred or sold. We may change or end an offer at any time; referrals already qualified when it ends are honoured.

Daily challenges

The challenges are for interest. Scores are recorded against your posting alias and shown on a leaderboard to other members. They carry no prize, form no part of your professional profile, and are never shown to a recruiter. Automating play, or playing to manipulate the leaderboard, may cost you access to it.

Recruiter accounts and plans

Recruiter accounts must be registered with a work email address, may be asked to confirm the organisation behind them, and may be suspended or removed if the account or its company cannot be confirmed, or if the rules above are broken. Recruiters are identified to candidates by name and company, and cannot use the service anonymously. Information a candidate releases to you may be used only for the role you described it for.

A plan includes a number of candidate invites per period: inviting a candidate uses one. Invites are a unit of access, not currency: they have no cash value, cannot be transferred or exchanged for money, and are not sold separately from a plan. A candidate releasing their identity is never charged for, on either side.

A hiring account requires a plan, monthly or annual, chosen at sign-up and billed in advance in US dollars through our payment processor, Stripe. We do not receive or store your card details. Without an active plan you can set up your account and roles and see how many candidates match them, but not see, open or invite candidates. A plan renews automatically each period until cancelled, and you can cancel at any time from the Subscription page; cancelling stops the next renewal and leaves your access in place until the end of the term you have paid for. Invites are granted for each billing period — a month on the monthly plan, a year on the annual plan — and unused invites do not carry over. Prices may change; a change applies from your next renewal and we will tell you before it does.

Payments are final. We do not refund a plan, any part of a term, or unused invites, including when you cancel before the end of the term you have paid for; cancelling stops the next renewal, and your access runs to the end of the term. Where the law where you live gives you a right to a refund that cannot be excluded, that right is not affected.

AI-generated material

Profile summaries, match scores, interview preparation and news summaries are produced by automated models. They can be wrong. Read a summary before you rely on it, edit or replace the one on your profile if it misrepresents you, and treat a match score as a starting point rather than a verdict. The decision to approach, interview or hire anyone is made by a person, never by the service. We do not accept responsibility for decisions made on the strength of generated material that you could have checked.

Third-party services

Payments are taken by Stripe under its own terms. If you sign in with Google, or another provider we offer, that provider's terms govern your account with them, and we receive only what it shares with us to sign you in. Career Hub videos open on YouTube under its terms. We are not responsible for a third-party service being unavailable or changing what it offers.

Our platform

The IncognitoH name, logo, software and site design are ours. You may use the service for its intended purpose and nothing else: no copying, reverse engineering, reselling, or building another product on it. Suggestions you send us may be used without any obligation to you.

Availability and liability

The service is provided as it is. We work to keep it available and accurate, but we do not guarantee uninterrupted service, that you will receive matches, or that any particular outcome will follow from using it. We are not a party to any employment relationship formed through the service and are not an employment agency.

To the extent the law allows, we are not liable for indirect or consequential loss, including loss of employment, income, or opportunity, and our total liability to you for anything arising from the service in any twelve-month period is limited to the amount you paid us in that period. Nothing here limits liability that the law does not allow to be limited.

Ending your use

You can delete your candidature at any time, and ask us to close your account. We may suspend or close an account that breaks these terms. Terms that by their nature should survive the end of your account, such as ownership, liability, and the restrictions above, do so.

Changes

We may update these terms. If a change materially affects your rights, we will tell you at least fourteen days before it takes effect. Continuing to use the service after that means you accept the updated terms.

Governing law and disputes

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. If we have a dispute, write to us first and we will try to resolve it with you within thirty days. A dispute that cannot be resolved that way is brought in the state or federal courts in San Francisco County, California, unless the law where you live gives you the right to bring it elsewhere, in which case that right is not affected.

General

These terms, the Privacy Policy and the Cookie Policy are the whole agreement between you and IncognitoH about the service. If any part of them cannot be enforced, the rest still applies. If we do not act on a breach straight away, we have not given up the right to act on it later. You may not transfer your account or these terms to anyone else; we may transfer them to a successor that takes over the service, and will tell you if we do.
